2019 LOR Foundation #expLOReTaos GeoTour

NO PURCHASE NECESSARY TO ENTER OR WIN. NO ENTRY FEE. COMMON TERMS USED IN THESE RULES: These are the official rules (“Official Rules”) that govern how the LOR Foundation (“Sponsor”) will operate the 2019 #expLOReTaos GeoTour Promotion (“Promotion”). In these rules, “we,” “our,” and “us” refer to Sponsor and its agents or contractors. “Participant” refers to an individual Promotion participant. “Nonprofit” refers to an organization from a list of Sponsor-approved organizations (included herein).

BY PARTICIPATING IN THE PROMOTION, PARTICIPANT AGREES TO SPONSOR’S TERMS AND PRIVACY POLICY AVAILABLE AT http://lorfoundation.org/privacy-policy/. IN ADDITION, PARTICIPANT UNDERSTANDS AND AGREES THAT THE PARTICIPANT’S ENTRY AND ALL PERSONAL INFORMATION COLLECTED FROM PARTICIPANT MAY BE STORED BY SPONSOR AND THAT PARTICIPANT MAY BE CONTACTED ABOUT THIS PROMOTION OR SIMILAR PROMOTIONS BY SPONSOR. PARTICIPATION IN THE PROMOTION CONSTITUTES PARTICIPANT’S FULL AND UNRESTRICTED AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES.

Important Note: This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, or Instagram, and by participating in this promotion, participant agrees to completely release and hold harmless Facebook, Twitter, or Instagram, from any liability whatsoever arising out of participation.

1. Eligibility

The Promotion is open to individuals eighteen years of age or older who are legal residents of New Mexico and have a valid social media account at the time of entry. Employees of Sponsor; its respective subsidiaries; its respective advertising, promotion, fulfillment, or other coordinating agencies; (collectively, the “Promotion Entities”) and their respective immediate family members and persons living in their same household, whether related or not, are not eligible to enter.  Sponsor grantees and their staff and family members are eligible to participate. Unless otherwise prohibited by these Official Rules, employees of organizations that currently receive funding from Sponsor are eligible to participate.

2. Promotion Description and How To Enter

The Promotion is a scavenger hunt that involves Participants finding “geocaches.” There are two ways for Participants to earn funding for Taos, NM-area Nonprofits. Either way, Participants must locate hidden geocaches using the clues provided for this Promotion on the Geocaching mobile app (details below).

Weekly Drawings. To enter, a participant must find a geocache, take a photo following the instructions inside the geocache, post it to Facebook, Twitter, or Instagram, and tag @LORFoundation and include the hashtag #expLOReTaos in the body of the post. Posts must be public.  Limit one entry per Participant per geocache. Each week, a winner will be randomly selected to designate $1,000 to a Taos, NM-area Nonprofit.

Grand Prize Drawings. Participants that complete the entire “tour” by finding all 10 geocaches, submitting all 10 photos in one single post (or in multiple posts on Twitter), tagging @LORFoundation and including #expLOReTaos in the body of the post, will be entered in a drawing to earn $5,000 for a participating Nonprofit. Four randomly selected participants who complete the tour as stated above will earn $5,000 for a Nonprofit.  Limit one entry per Participant.

3. About the Geocaching Experience

Geocaching is real-world treasure hunt played with a GPS device or mobile phone. Players search for hidden geocaches on their own or with their friends and family. To learn more about the geocaching experience visit www.geocaching.com/guide.

All Participants must download the Geocaching app on their smartphones, create an account (if they do not already have one), and find the LOR Foundation #expLOReTaos GeoTour. From there, Participants will select a geocache from the list and follow the clues to find the hidden geocache.

4. Promotion Period

The Promotion begins at 12:01 AM MT on Wednesday, July 17 (the first date and time entries may be submitted). The Promotion ends at 11:59 PM MT on Tuesday, September 10 (the last date and time entries may be submitted).

5. Winner Selection and Prizes

For weekly drawing entries, Sponsor will randomly select one potential winner via a random drawing during each week of the 8-week Promotion Period.  Sponsor will announce weekly potential winners throughout the Promotion Period. Each weekly potential winner will select a participating Nonprofit to which Sponsor will award $1,000.  Entries from each weekly drawing will not carry over to successive weeks. Weekly drawings will take place on Wednesdays during the promotion period: July 24, July 31, August 7, August 14, August 21, August 28, September 4, September 11.

For grand prize drawing entries, Sponsor will randomly select four Participants who complete the entire “tour” via a random drawing at the end of the campaign. Each of the potential four grand prize winners will select a Nonprofit to which Sponsor will award $5,000. Grand prize winners will be selected Wednesday, September 11.

Each Participant may win a maximum of one (1) weekly drawing and one (1) grand prize drawing prize.  Odds of winning depend on the total number of eligible entries received. Prizes are non-transferable.  Sponsor will not award any prizes to Participants.

Sponsor will share winning entries (weekly and grand prize drawings) and tag the winners’ social media account through which the winner submitted the entry. Sponsor will attempt to contact the winner through social media following the announcement.  In order to be awarded a prize, selected potential winners must sign and complete a General Release of Liability and Publicity Release and return it within one week of the date of the selected potential winner’s receipt of prize award notification. Additionally, failure to select a valid Nonprofit of choice within one week of notification or failure to follow the terms and conditions of these Official Rules may cause Sponsor to disqualify a potential winner (with the potential winner forfeiting any eligibility for an award). In such case, Sponsor may select an alternate potential winner from the remaining entries.  Notwithstanding the foregoing, the board of directors of Sponsor retains final control and authority regarding the approval of the awards.

6. Entry Content Guidelines

Entries MUST:

  • Be in English or Spanish
  • Include a clear photo following the instructions inside the geocache
  • If submitting an Entry for a completed GeoTour, include photos from all 10 caches in one post on Facebook or Instagram, or in three separate consecutive Tweets on Twitter
  • Tag @lorfoundation
  • Include hashtag #expLOReTaos

Entries MUST NOT:

  • Discriminate against, disparage, or denigrate on the basis of race, ancestry, place of origin, color, ethnic origin, citizenship, creed, sex, sexual orientation, age, record of offenses, marital status, family status, physical or mental disability, language, or any other ground prohibited by applicable legislation;
  • Disparage or denigrate a product, service, person, company, or organization including, but not limited to Sponsor or any other Promotion Entity;
  • Promote alcohol, illegal drugs or activity, tobacco, firearms/weapons, prostitution, or pornography;
  • Contain any profanities, be overtly sexual, suggest an intent to abuse, or contain suggestions of violence;
  • Involve religious advocacy or proselytizing, defined as acts and intentions to advance a religious denomination or expand membership or encourage conversion;
  • Involve political advocacy such as acts and intentions to advance a particular political party, candidate or to support any particular party, candidate and/or cause, or to expand membership or to encourage membership for a particular political party, candidate or lobbying effort or voter registration drive feature or reference any third party;
  • Describe a project that directly or principally benefits the Participant or any other specific individual (as opposed to the identified Nonprofit);
  • Feature any third-party commercial products and/or company trademarks, logos, brands, or endorsements (including but not limited to third-party logos on street scenes, panoramic views, vehicle license plates, or clothing, such as t-shirts or hats); an Entry may contain the name and trademark of an organization to be benefited by the award, provided prior permission has been obtained from such organization;
  • Use individuals’ names or likeness, in whole or in part, without permission (including but not limited to identifying pictures); or
  • Contain materials embodying the names, likenesses, photographs, or other identifying elements of any person, living or dead, without permission.

Entries must: (i) be original and of Participant’s own creation, and (ii) not violate the intellectual property or proprietary rights of any other parties. Sponsor may, in its sole and absolute discretion, reject, refuse, remove, delete, and/or disqualify or disallow any entry that Sponsor, in its sole and absolute discretion, deems inappropriate or otherwise non-compliant with these Official Rules. If Sponsor or any Promotion Entity, at any time during the Promotion Period, receives a complaint (including but not limited to a cease and desist letter, general letter of complaint, etc.) alleging intellectual property infringement in an entry, Sponsor may, in its sole and absolute discretion, disqualify the entry without prior notice to Participant.

7. Approved Nonprofits

The following is a list of approved Nonprofits among which potential winners may choose.  All donations will be made by Sponsor. No donations will be made in any Participant’s or Winner’s name.

  • Enchanted Circle Trails Association
  • Not Forgotten Outreach
  • Rocky Mountain Youth Corps
  • Taos Community Foundation
  • Taos Land Trust
  • Taos Valley Acequia Association
  • The Paseo Project
  • Twirl Play & Discovery Space

8. Taxes

There may be some tax implications for Nonprofits. Sponsor recommends that winning Nonprofits review their award with their legal/tax advisor to determine their potential tax liability, if any, in connection with receiving an award as part of the Promotion. If there is any tax liability, it will be the sole responsibility of the Nonprofit.

9. Grant of Rights to LOR Foundation

Submission of an entry constitutes Participant’s certification that the entry is Participant’s own original work and Participant represents and warrants that the entry does not and will not infringe the intellectual property or proprietary rights of any third party, including, without limitation, any third-party patents, copyrights, or trademarks. By submitting an entry, Participant hereby irrevocably grants and assigns Sponsor, and its respective successors, an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers), and transferable license and right to use, copy, transmit, or otherwise distribute, perform, modify, create derivative works based upon, incorporate into other works, publicly perform, and display the entry or any portion thereof, in or through any medium, whether now known or hereafter created.

Nothing herein will constitute an employment, joint venture, or partnership relationship between Participant and Sponsor. Participant also irrevocably grants Sponsor, and its respective successors and assigns, where not prohibited by law, an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers), and transferable license and right to use the name, voice, likeness, and biographical material of Participant or (if Participant is a group or organization) members of Participant, in any merchandising, advertising, marketing, promotion, press releases, social media, or any other purpose related to the entry and/or Promotion or in any other way Sponsor deems appropriate.

10. General Conditions

In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the social media account the entry originated from.

By entering the Promotion, Participants agree to be bound by these Official Rules. Sponsor is not responsible for phone, electrical, network, computer, hardware, software program, or transmission malfunctions, failures, or difficulties. By entering the Promotion, Participants further agree to release, indemnify, defend and hold Sponsor, Facebook, Twitter, or Instagram, the other Promotion Entities, and their respective affiliates, subsidiaries, directors, officers, employees, shareholders, sponsors and agents, including advertising and promotion agencies, assigns, and any other organizations related to the Promotion, harmless from any and all claims, injuries, damages, expenses, or losses to person or property and/or liabilities of any nature that in any way arise from participation in the Promotion or acceptance or use of an award, or parts thereof, including, without limitation, (i) any condition caused by events beyond the control of Sponsor that may cause the Promotion to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of an award, or acceptance, possession, or use of an award, or from participation in the Promotion; and(iii) any printing or typographical errors in any materials associated with the Promotion. Winners agree to be bound by these Official Rules, and Sponsor’s decisions in all respects relative to the Promotion are final.

IN NO EVENT WILL PROMOTION ENTITIES BE LIABLE TO THE PARTICIPANT, WINNER, OR NONPROFIT, AS APPLICABLE, FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH THE APPLICANT’S PARTICIPATION IN THE PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT ANY PROMOTION ENTITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to the Applicant.

ENTRIES ARE THE VIEWS OR OPINIONS OF THE RESPECTIVE PARTICIPANT, AND DO NOT NECESSARILY REFLECT THE VIEWS OR OPINIONS OF SPONSOR OR ANY OTHER PROMOTION ENTITY IN ANY MANNER.

Any waiver of any obligation hereunder by Sponsor or any other Promotion Entity does not constitute a general waiver of any obligation in favor of Participant(s). If any provision, license, or right in these Official Rules is restricted or invalidated by an applicable law or legal judgment, the remainder of these Official Rules will be construed so that all other legally permitted provisions, licenses, or rights in these Official Rules remain valid and enforceable.

Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Promotion, in whole or in part, in the event of fraud, technical or other difficulties, or if the integrity of the Promotion is compromised, without liability to Participants. Sponsor reserves the right to disqualify any Participant or Winner in their sole and absolute discretion. The Promotion is void where prohibited or restricted by law. The Promotion is subject to these Official Rules and all applicable federal, state, provincial, and local laws and regulations.

By participating in the Promotion, Participants acknowledge that they have read these Official Rules and agree to abide by them and by the decisions of Sponsor, which are final and binding on all matters pertaining to the Promotion. These Official Rules are governed by the law of the State of New Mexico, excluding rules governing the choice of laws. Any action, suit, or case arising out of, or in connection with, the Promotion or these Official Rules must be brought in either the federal or state courts located in New Mexico.
